how do I go about getting a divorce if we both agree on the separation to complete the divorce and there is no community property to be settled???

Most lawyers will handle an uncontested divorce for a fairly small fee. Look around this site for one in your locality. I don't even do contested divorces much anymore, but I will still handle uncontested ones, as will most any solo practitioner.

Essentially, you two need to execute a community property settlement agreement (unless you were only married for a day, there is community property, even if you aren't fighting over it), draft the pleadings and the Judgment, then file the divorce pleadings wth the court and obtain the final Judgment from the Court.

You should be able to find a competent lawyer to do the whole thing for around $2,000, including the court costs, attorney's fees, everything. Assuming everything stays amicable, the whole thing could take less than a month to negotiate, draft, and finalize.
