Divorce and Spousal Abuse

Married 8/13/2000. I am the owner of a home health agency. He is a carpenter. I supplied all the computer equipment, some employees (using my payroll) purchased him a new truck in cash. He paid no living expenses while living in my home. I paid for a booth at home builders association in Baton Rouge and his website. No reimbursement. When times began becoming tough for me, he split. Left he with the truck and walked away. All of my equipment is in his place of business. I went yesterday to set up an appointment to get them back and he hit me in the face with a closed fist, I blacked out, and took pictures of the damages. Police were called but stated because I battered him (I kicked him in the groin trying to get away) nothing was done but a report was filed. He has paid not one penny toward household expenses, etc. In March he received his General Contractors License. This is an educational expenses to help him, right? There are no children involved. What must I do to prepare my case, if I have one?

Your question did not say what "case" you were preparing for, but I assume it is the community property issue. Unless there was a prenuptual agreement, everything purchased during the marriage with community funds is community. Additionally, all income, no matter the source, is community during a marriage without a prenup. So, everything purchased is 1/2 yours, including his construction company. If you spent separate funds during the marriage, that is, money you had in savings before you married or inheritance, and there are some others, then you have the right to be reimbursed 1/2. But please, get an attorney.
