Legal Question in Family Law in Louisiana
I was divorced in Louisiana and child custody and community property was not settled. Six years have passed and my daughters father can not be located. They have not seen or heard from him in six years. My daughter needs a passport to travel out of the country with her school this summer. Can I get sole custody if I can not locate the father? We are currently searching for him to make the court process shorter. If by chance he is located can sole custody be granted based on abandonment? Six years ago, I was granted temporary custody and he was ordered to get treatment for anger managment.

Sure you can, and if you are married, your present husband can adopt the child rather easily. If you want sole custody, file for it, declare that his whereabouts are unknown and have a curator appointed to try to find him. Give the curator all the information you know about him and his relatives and their locations, and then wait for his report. Failure to visit for 6 months would allow your present husband to adopt, if you have one, and would certainly get you sole custody.
