Legal Question in Family Law in Louisiana

I was divorced in Louisiana and custody awarded to my ex wife. Hurricane Katrina displaced them to her home state of Florida and they never returned to Louisiana. I have since moved to Florida and my son now lives with me. To be legally the custodial parent, do I have to file in Louisiana or can it be done in Florida?

Since the child now lives in Florida that is the most appropriate state.

I suggest you file in Florida and attach a certified copy of the original Judgment with the request for the court to take Jurisdiction and award you domiciliary status, or sole custody as appropriate.
