Drug Screen

My ex husband is taking me to court to try and get full custody of our kids. He has made false statements about me to his attorny about drug use, now his attorny has served me papers to go to court and they want me to take a drug screen 24 hours after being served. I am not yet represented by counsel. I do not have the money to take the drug screen at this time. My question is do I have to take the drug screen?

If you have faith that you are clean, call his lawyer and ask him to have your ex pay for the screen. Whether or not you "have to" take the drug screen depends on if it is written in an order signed by the judge (as opposed to it being suggested in the petition but not ordered).

You need a lawyer but if you can't afford drug screens then defending a custody fight is much more costly. Call the local legal services corporation (legal aid).

If you are that poor then there is a good chance that he is not paying enough child support.

Call his lawyer and tell him you will do the screen if they pay for it. From reading between the lines, I suspect your ex has a new wife and maybe even a new child.....since you have more than one child, have you calculated the child support lately? Drug tests are not that expensive.
