Emancipation of a minor in Louisiana
I am 17 and I am engaged. My mother does not like my feonce. They refuse to let us see each other or speak to eachother. She also refuses to let me wear my engagement ring. I have a steady job as does my feonce, and he has an apartment which will be where we live once I turn 18. I turn 18 in November of this year and graduate in December. My mother and I fight constantly. I am at my breaking point and can't handle it any more. Is emancipation a possibility, or would a judge look at me and laugh? Please help.

First of all, I am not recommending you do anything, just telling you what the law is. You are not a juvenile and not an adult. You're in between. You can do anything you want to do in the context of what you have posted here. The juvenile authorities have no jurisdiction over you. You are not old enough to marry until you're eighteen. Yes, you can be emancipated. However, it is your parents who have to bring a civil petition for emancipation; you cannot do it, as you have no procedural capacity to bring a civil aciton until you are an adult (18). You cannot get married without your parents' consent, at least until you are eighteen. However, if you can support yourself, you have every right to move out. As I say, I am not recommending anything, just telling you what your rights are. There is more to it than this, but this is someting to think about. Best of luck!
