Legal Question in Family Law in Louisiana

Ex-wife is taking my daughter out of town.

My ex-wife & I have joint custody of my daughter. During Katrina she took off with my daughter and did not hear from her until a month after. And she would not tell me where she was. Her family would not tell me of her whereabouts either. I got a lawyer involved. After 6 months I located her and drove to FL, and she got served, to come back to Louisiana. But she's planning on going to FL this summer and I'm afraid she might take advantage of the situation and not come back. And she would do that, during that time she was away she was even telling my daughter to call her boyfriend daddy. How should I go about this? Is there anything I can do to make her give the info & address of where she is going? Please help me. I AM TERRIFIED TO NOT EVER SEE MY DAUGHTER AGAIN!!! PLEASE...HELP.

Re: Ex-wife is taking my daughter out of town.

The law is she cannot move the child out of town without your permission or until, after a hearing, a judge decides it is in the child's best interest to move to the new state. Of course your lawyer will know all this and should act accordingly. Maybe you should seek to have yourself designated the domiciliary parent. Realistically speaking, pieces of paper mean nothing if someone decides to ignore them, and if your ex is determined to move she will and you will have to rule her back into court. Should she do that, definitely try to be designated the domiciliary parent. Merely having a boyfriend, husband or job in another state is not sufficient to authorize moving a child to another state.
