the father of my child has not seen her in almost 3 years i wan to know what can i do to get his rights taking away she almost 4 and i want him out of her life before i have to explain to her why she has that last name

Unless there is a man, ie your husband, who wants to adopt her, then there is nothing you can do. Your child deserves to be supported, and if you attempt to simply end the father's parental rights, AND his obligations, without another man to take his place, then I am afraid you are out of luck.
