The courts in Louisiana decide matters involving children by looking at what would be I'm their best interests. Having both parents participate in raising the child is presumed to be in the child's best interest. To overcome this presumption, evidence must be introduced to show the other parent is unfit, unable or unwilling to parent. If a parent has been an intentional absentee for a significant time period the Court will examine this issue closely.
