Does a father have the same rights as a mother if neither has custody and the mother moved the child out of state?

If you were married when the child was born, or not married and your name is on the birth certificate, then you would have the same rights. But you cannot demand to exercise any rights without going to court and getting a judgment. You may have trouble filing anything in another state other than the state where the child is living.
