Father's Rights

My husband and I have not yet legally seperated but we have not lived together for almost eight months. I ride to work every day with someone else because I don't have a car because he wrecked mine.I try to bring her to see him as much as possible but that is not easy when you have to borrow someone's vehicle.So he threatens me saying that I'm going to be in trouble because he doesn't get to see her every day.What I'm wondering is do I have to let him see her at all if there is no court order for visitation for him to see her. He wants to keep her on the weekends and that just really makes me nervous because she is almost eight months old and he has never stayed one night alone with her. He has never changed one diaper, fixed one bottle, or dealt with the day to day routine of taking care of a baby. He wouldn't know what to do with her if he had her. So I would just like to have some kind of idea of what his rights are as far as taking her off for the weekend or something like that. Like I said he has no court order for any kind of visitation so I'd just like to know exactly what his rights are as far as taking her off and visitation.

First, since you have been living apart more than six (6) months, a divorce is not legally complicated.

Your bigger issue is the custody, support and visitation of your daughter. Because there is no custody order, there are no rules. Either of you could take the baby and keep the other from seeing her.

You need a Court order setting custody, visitation and support of the child. Contact an attorney.
