Legal Question in Family Law in Louisiana

My fiance is up for modification of child support. His ex is convinced we are hiding money. Through her lawyer, she has initiated a discovery. Many of the documents requested do not apply to us (i.e. passports and Certificates of deposit). How do we legally prove we do not have these documents?

You answer the request for production of documents by stating that you do not have any CDs. You do not have a passport, etc. She will have to prove you do have them. You do not have to prove you don't. You should always be truthful in answering discovery because you are swearing that you are being truthful.

To add to what Ms. Lucas said, if you say you don't have certain things and they discover you lied, it will cost you a whole lot more than had you come clean.
