Where to file for a divorce

I currently live in Louisiana but my wife lives in Ohio. She refuses to file for a divorce and says that she will not sign any papers for one either. My question is, should I travel back to Ohio to file or should I file in Louisiana?

Dear LawGuru Friend,

Of course, I to not like to say anything to encourage a couple to get divorced; but, if it is going to happen anyway, you can simply file suit here in Louisiana and have the court appoint a Curator (Attorney) to receive the papers on her behalf. That assumes that Louisiana has jurisdiction to decide your case, and that depends a lot on where you and she (1) got married, (2) last lived together as man and wife-last matrimonial domicile. There is more to it all than this, but this is something to consider. Hope you and she can patch it up; but either way, good luck!

If there are minor children of the marriage then I suggest that you file in the state where the children live. Otherwise you can file in Louisiana in the manner suggested by Mr. Parkerson.
