Can he file kidnapping charges?

My husband has 2 police reports for domestic abuse, from myself, filed against him. I want to seperate, my family lives in Mobile, AL, I reside in Baton Rouge. Is it legal to move myself and the children to Mobile, without him filing kidnappoing charges?
