Filing for divorce across state lines

I was married in Tennessee, recently moved to Louisiana, but not a resident yet. Do I need to file in Tennessee or Louisiana? Do I follow TN divorce guidelines if I file in LA? Also, if I file in Dec 08 can I still file with my husband for tax purposes?

If you intend to be a resident of Louisiana you may file here. You have a choice of claiming separate or married filing status for the year you are divorced. I assume you "lived" in Tennessee after your marriage, and therefore you would be subject to the property laws there, but the divorce laws here if you decide to file here. You have a year to decide whether to become a community property couple in Louisiana. However, since Tennessee is not a community property state and you are getting ready to divorce, the Louisiana Community laws should not be an issue.
