Legal Question in Family Law in Louisiana
Ex is trying to take everything
I was with a guy for 5 years and we have a daughter together. We reciently broke up and to split things up are becoming hard. We were never married, we were engaged. This is my problem/question. We had 2 vehicles. His dad bought him a car (the title is still under his dad's name) and we have a truck that is under my ex's name. He let me take the truck because of our daughter. A friend of mine told me that by law he has to provide me with a vehicle. My ex is giving me problems about the vehicle because I am asking him to donate the car to me for my safety. If he gets mad, he could report it stolen. But he is not willing to sign it over. Is there anything I can do? By law is he supposed to provide me with a vehicle like my friend said? He has a new car already, it would be an extra car if he took it from me.

He does not "have" to furnish you with anything. Since you were not married, he does not owe you spousal support, but would owe you child support. File for custody and child support and ask for a division of property acquired as "co-tenants." I doubt that you have much claim, but you can try. Also remember that no one has "legal" custody until the court makes that judgment.

Get a lawyer & file for child support. You can ask for a car but I cannot promise that the court will award one to you.
