Legal Question in Family Law in Louisiana

Half-sisters rights for coustdy

I was granted custody in a Texas court. After being awarded custody, a Louisiana Judge granted my ex-stepdaughter custody in Louisiana. This Judge did know about the case in Texas. Now if I go to Louisiana they will take my son from me.Shouldn`t the court ruling in Texas be good in Louisiana also. This Judge in Louisiana was asked''If he had any problem with Texas court making the final ruling.''Because we were from Louisiana, but now live in Texas.

I wonder why the Judge in LA didn't know about the case in TX. The first filed case should take precedence. If that is the TX case, you will have to take action in LA to void that judgment.

Each State is required to give full faith and credit to Judgments of other states which are valid in the state where rendered. You could file in the court in La. asking it to recognize the Tx Judgment and to rescind the La one. The Uniform Child Custody Jurisdiction Act was adopted by all states to avoid what you report happened in your case. I do not understand how the La court rendered judgment without your knowledge, and if you knew the papers were filed, why you did not challenge the La court, or tell the texas court. Either way, the UCCJA would have required whichever court learned of a pending custody matter in another state to contact the other state court and between them decide which one was the most appropriate to hear the custody issue.
