Can my husband have our children overnight while his girlfriend stays there overnight as well? We have been separated for 3 months.

If there is no custody/visitation order in place, then he can just about do what he wants if it is legal. Not knowing your children's ages, introducing another female into his children's life as if she were equal to mom is repugnant but not illegal. If there is no custody/visitation set, then you do not have to let him have the children until one is in place. Of course he could come and try to take the children since he has as much right as you to them. So, file for divorce and immediate temporary domiciliary status. Then in the custody/visitation order, you can have put in there that neither of you may have a person of the opposite sex overnight when the children are staying overnight. In your husband case, I would not be surprised if the kids report that "Aunt whoever spent the night with us last night" mommy.
