Legal Question in Family Law in Louisiana

My husband and I are still legally married due to the fact I have not had the money to file for divorce and he just doesnt care. We have been seperated for 6 years and our 2 children have lived with me. The first of the year in 2011 I asked if he could help with them for awhile due to my financial situation. At that time he took them to Alaska (we lived in Missouri) and now he does not want to give them back or let me talk to them. I have since moved to Louisiana. This summer he is going to take them to New Mexico to visit. I am going to meet them there at least to see them for a while, but if the kids want to come with me can i just take them from him or will i be charged with kidnapping since no custody orders have ever been filed.
