Legal Question in Family Law in Louisiana

My Husband is wanting to adopt my child. Their bio father hasn't seen or spoke to them in 3 1/2 years. He is court ordered to pay child support in which he does not pay and has never paid. I was awarded sole care, custody, and control of my child. He was only allowed to have supervised, restricted visitation. How do I go about starting the process?? Do I have to have the bio father's consent.

You will either have to get the biological father's consent or you will have to terminate his rights. Many judges do not like to terminate father's rights so a voluntary surrender by the biological father is the best way if it is possible. You do have grounds for termination as he has not supported them/nor visited in over 2 years.
