Legal Question in Family Law in Louisiana

My husband will be in court soon to try and get support he is paying to the mother of his youngest child dropped seeing as how she doesn't have the child living with her nor is she financially responsible for the child. Is there something he can ask of the judge while he is in court to get custody of child at least till there is a custody hearing?

He will have to petition the court for custody. The judge can only rule on pleadings filed and in front of him or her. If the State has custody of the child, he can work with the Child Protection Agency to get custody or he can again petition the court for custody.
