illegal child custody
my ex husband step mother has my son and is has stop all contact. the only way i know what's going on with my son is by calling my ex. i'm unfit and never was. fallen on hard times but it was job related. my son is also in another state. the divorce did not include child custody because it was a verbal agreement. my ex husband as never raised our son his step mother has. what can do to get my son back?

You can try to file for custody in the Divorce suit, but that could be kicked to the state where the child actually lives. If you claimed there were no children of the marriage, then you would have to amend the Petition. You do not say how long the child has lived with his step-grandmother, but in the end, the best interest of the child will rule. Since you said you have fallen on hard times, you should seek legal aid because you will definitely need an attorney.
