without a will our brother died and he left one person, who he clamied as his daughter. There is no birthcert. with the brothers' name. the child carries her mother's name

An illegitimate child can inherit from a father if he/she follows precise procedures to establish his/her parental relationship with a deceased father. They have a limited amount of time to do so.

An illegitimate child can inherit. If your brother held the child out as his to the public, then he probably has acknowledged his paternity.
