Income tax regarding child support.

The father of my child filed our son on his income tax. He hasn't financially supported our son and given him one cent from the money he received from his income tax. I wanted to know is it fraud to claim a child on your income tax and not support him financially? Also am I entitled to half the income for our son because we did live together and we had a verbal agreement that I would not work for the first year of our sons life? Also if I was to take it to small claims court to receive the money, what claim would that fail underneath?

You could probably report him for tax evasion, but that may result in his being sent to jail, thereby cutting off your chances at enforcing child support. You should consult with a local attorney as to what avenues are open to you.

First, small claims court has no jurisdiction over child support in Louisiana and I doubt it has jurisdiction in Georgia.

These issues are complex and I strongly suggest that you consult a lawyer.
