Legal Question in Family Law in Louisiana

Indepth Custody Law

I want a divorce from my husband, and would like to know if I could move my child from New Jersey, to Louisiana legally? Me and my husband are married, yet there has been documented abuse. I don't want to take full custody, because I feel that being able to be with both parents is important in a childs life.

Re: Indepth Custody Law

Thank you for your inquiry. The key to your removal of the child from the jurisdiction of the state of New Jersey revolves around what "good faith" reasons you have for going to the state of Louisiana.

As it would be my pleasure to speak to you regarding your situation, please feel free to contact my office at 732 246 0909 to discuss same.

Very truly yours,

Re: Indepth Custody Law

Because the child is a New Jersey resident, Louisiana will defer to the New Jersey courts. If you move and the child lives in Louisiana (generally six months) then Louisiana will have jurisdiction over the child custody issues.
