Interstate Adoption

The parents of our niece and nephew surrendered they're rights. We are trying to adopt the kids and want to know if the state has a right to let someone outside the family adopt before our homestudy is done. We live in another state. Or do they have to wait to see if family is approved first.

It depends. Was the sibling the child's father or mother? If the father, was the father the legitimate father?
