i am currently in Iraq with the army. I go on R&R in a week and I wanted to stay with my fiance. She has a two year old son and has the "Shack Up" clause in her child custody agreement. Does this clause still apply even though she is engaged and if so, what would be possible consequences if she did break the clause?

Thank you for your service. Yes, the prohibition still applies even if you are engaged. It could be very serious, depending on the jurisdiction and the Judge. Some judges are more strict on that sort of thing than others.
The prohibition only applies while the child is in residence. The idea is that the child is not allowed to be present in the home when her mother has an overnight guest of the opposite sex. Send the child to her father while you are in town and there should be no problem.
