Legal Question in Family Law in Louisiana

LA Community Property Laws

Is it lawful for monies owed to either party in the divorce for outstanding community bills to be deducted from their 1/2 of the accrued retirement accounts? Or, should/can those retirement account monies be separate from the partitioning of the assets and liabilities of the marriage?

Secondly, the judge ordered in 2003 that 1/2 of all retirement accts be transferred to me. Is it lawful for community bills to be deducted from my half of these monies? Or, should my entire 1/2 half come to me without deductions by my former husband of 20 years.

Re: LA Community Property Laws

The judge's order, apparently, is some five years overdue in being complied with. At this rate of compliance and with the deduction of "community bills" from the sums that the judge ordered paid to you some five years ago, in another five years there may be nothing left to transfer to you.

Better see a lawyer about this(preferably the one who hopefully represented you five years ago)and find out what's goin' on here.
