Is name legal for marriage

My boyfriend & I are planning to wed soon. His father & mother was never married. On his birth certificate his last name is his mother's last name. His mom died and his father took him in when he was 14 yrs old. He changed his last name to his father's last name. This was not done legally (with the courts/attorney). Now that he is 45 yrs old, everything he owns/have is with his father's last name. What would my name be if we wed? Will he have to do anything to legally change his last name on his birth certificate?

I would just do a name change suit. It's not a real big deal if he doesn't have a criminal record. It has to be filed against the DA. Check with an attorney in your area.
