Legal Question in Family Law in Louisiana

Legal rights for children leaving country?

I have two children. The mother wants to take the children out of the country to live and I do not want them to go. What are my legal rights and what are hers. She currently has custody of both children and now won't even let me see the children if I don't agree to sign and let them leave the country. What are my best options and what is the best way to handle this matter?

Re: Legal rights for children leaving country?

Dear Law Guru Friend,

What Mr. Casanave is telling you is correct. Also, if you have any kind of visitaiton rights under the court Judgment that gives your wife or former-wife custody, then sue your wife or former-wife to have her held in contempt for her failure to honor your rights of visitation. If you are divorced from her and have visitation rights already, I would also ask for damages for wrongful denial of your visitaiton rights. If you do not have visitation rights, sue for such at the same time you sue for the injunction that Mr. Casanave recommended. Best of luck! Act now!

Sincerely,

Hardy Parkerson, Atty.

Hire a lawyer immediately and get an injunction forbidding the mother from taking the children out of the country. Once they are gone, even if it is a cooperating country, it would be a long, expensive process, at best, getting them back.
