Legal Question in Family Law in Louisiana
Live in boyfriend
There are four people living in this household, myself, my younger brother, my Mom and my Mom's boyfriend. The house is still under my deceased fathers name. My parents divorced about 9 years before my father passed away. My Mom's boyfriend is an alcoholic and gets extremely violent at times when he is drunk. (Violent being, throwing things, breaking things, punching holes in walls, verbal threats with knives to our lives and his own.) My mom has told us that she don't have the right to throw us out, and we feel that we shouldn't have to move elsewhere since we both grew up in this house. Yet, she won't do anything about his abuse. What I need to know are my and my younger brothers rights in this household and are there any laws that protect our rights living in this household. Meaning, what steps should we take in the removal of my Mom's boyfriend, because she is allowing this abuse to go on. Do we have the right to dismiss him from the premesis permanetly, and if we do should we get a lawyer for help in this matter?

Re: Live in boyfriend
There are quite a few details that would help in answering your questions, but based upon what you wrote, you need to contact the police and tell them the whole story. If you and/or your brother are minors then the state can step in and get the guy removed. Unfortunately, since your mom is not willing to get rid of the guy, the state may be your only option.
