Legal Question in Family Law in Louisiana
I live in Louisiana. My daughter was born in 1998 and I was unmarried. No father is listed on the birth certificate and I have never filed for custody. When I got married, my husband showed violent tendancies, so for my daughter's protection, she went to live with my mother and I signed over power of attorney. Now my daughter is 13 and wants to come live with me but my mother won't allow it. What are my rights?

A power of attorney is not a custodial agreement or order. A power of attorney can be revoked at any time. If your mother does not have a custody order from a court, she does not have custody. You as the mother are presumed to be the best person to raise the child.
