If you have kids and they are with you you want child support.
You might not get spousal support. Many spouse don't. You can file for both and there is no legal penalty for asking.
Why would you do that? Child support is ALWAYS owed except in very special cases, but spousal support is rarely owed except in special cases. If you think asking for child support will stop him from wanting visitation, you must remember, child support does NOT depend on visitation and vice versa, AND, child support is owed to the CHILD not the parent! And why would any sane person file for divorce when they have children and not use an attorney?
