Louisiana Community Property Laws

My husband says he wants a divorce, I do not. In October 2004, he purchased a new vehicle for me. It was understood that I make the payment and pay the insurance, which I have. The car and financing is in his name only. If we divorce, can I keep the car and continue making the payments, which was our agreement? Our income is equal, and I can make the payments with no problem. I am just worried that since the car was only put in his name he is not going to let me have it.

If your husband wants a divorce and you're worried about property then get a lawyer. Since few people suddenly want a divorce he has probably been planning this break-up.

The vehicle is probably community property. That being said, if the car was purchased 2 or 3 months ago it probably has a significant debt attached (and very little equity). If this is so, unless it is a collector's item, you can get another like it if it is taken away.
