i have been married for 8 years first time marriage my husband has been married three other times. when the home was purchased it was purchasd in my name soley due to my husband having filed bankruputucy and not being able puchase a home. we have one child together. i have filed for divorce and hired a lawyer, he is refusing to leave the home he said his lawyer old him not to move out of the home and he does not want to go before the set court date and wants my lawyer and his lawyer to have a meeting to work out the details of the divorce. how can i get to keep my house or do i need to let the house go back to the mortage comany and prepare to move.

You have a lawyer. I assume as part of the Petition he asked for use of the family home for you and the child as well as custody, child support and interim spousal support. I also assume there is a date or dates set for the custody, child support and interim spousal support and to determine who gets use of the family home during the pending divorce. When you get to the hearing the court should give you the house to use until the community is settled and order him out under threat of contempt of court.
