Legal Question in Family Law in Louisiana

Mortgage

My husband and I are separated and have filed for divorce. the mortgage on the house was in his name alone, although the house is community property. I was paying the full mortgage note monthly for 6 months after he left, before I could no longer afford it and moved out, we put the house up for sale. He claims that in that time he did not have to pay anything on the house note because he was not living in the house and I was. Would he not have been liable for at least half of the house note for that 6 month period since his name is the one on the mortgage note?

Your lawyer should be able to answer that question. But with that said, if you paid his 1/2 of the community debt after you filed for divorce and the divorce is obtained, then he would owe you the 1/2. It being a community or separate debt is what controls.
