Mother, pregnaunt, doctor UA, THC, keep baby

I have a son in Louisanna. His girlfriend is due in 2 weeks. The doctor, last week, said when she is born he will pull a UA and test for THC, if she is positive, she cannot take the baby home. Can he do this? What about the doctor/patient confidentality?

Doctor/Patient confidentialy is statutory, not constitutional. The law regarding reporting of child abuse/neglect (which covers this) is also. This law, being more specific and newer, supersedes the privilege. The doctor MUST report evidence of abuse or neglect.
