My mother's home

My father died 6 years ago without a will, my mother did a succession and also named me as executor. My mother got a good offer to sell her home and my sister is refusing to sign, although she knows my mother's home is in need of repair. What legal action can my mother and I take to either make my sister sign. Also, if my sister refuses to sign because she says she owns 25% of the house, can she be held liable for her share of the house repairs that are necessary for my mother to continue living there.

You ask the court for permission to sell. Your sister does own 25%, you 25% and your mom 50%, but your mom also owns the usufruct which lessens the value of your and your sister's interest. The court can order the property sold, or give your sister the opportunity to find a buyer to pay more or to buy it herself.
