Legal Question in Family Law in Louisiana
Want to move/get out of my situation. Louisiana.
I'm 24 and have two children with my boyfriend. A 4 year old and a 1 year old. My oldest son has my last name and the father isn't on the birth certificate. My youngest son has his last name and he has signed the birth certificate but we keep getting it sent back due to misspellings in names, etc. My question is am I allowed to leave my relationship with him and move out of state without him trying to take me to court and get the kids back? If I stay in this state I have no one to help me at all, I have no money, I can't get any help from the state. My boyfriend is emotionally/mentally abusive and I want out of the relationship. I've not tried to leave because I'm afraid he's going to try and take my kids away from me and I don't want that. He does pay bills, and buy the things they need, but he never spends time with them or me when he is home, he is always on the computer playing video games. He doesn't look at us like a family, but more like a burden on his life and I want me and the kids to be happy. He has kicked in a door on me and shattered a mirror, and held me up against a wall by my neck before in the past and I left him, but did come back because he said he'd change, but didn't. Need help with this. Any help. Thank you.

If there are no court orders you are free to leave. Likewise, he is free to take the kids and leave you.
In the long run, you're probably better off getting the court order. I suggest you discuss this with a lawyer who practices family law.
