Legal Question in Family Law in Louisiana

Parental Rights

Can my husband get back his parental rights after giving them up? The childs mother is married and the husband is planning for adoption. My husband is the childs biological father and regrets it horribly. We want to know if there is anything we can do for her to be a part of our lives.

Re: Parental Rights

By "giving up" his parental rights you mean his parental rights were "terminated," then he probably cannot get them back. If he agreed to not see his child or want anything to do with it and not pay child support, then he has not had his rights terminated. However, if he has not tried to see his child in 6 months then there is a rebuttable presumption that his rights should be terminated and his permission is not needed in an intrafamily adoption. You do not say how old the child is, but I would suspect he has forfeited his right to object to the adoption.
