Legal Question in Family Law in Louisiana
My parents are trying to take away my child.
My ex-husband, who signed away his rights to our 2 year old, has joined with my parents to try to take custody of my 2 year old. I moved to Az. on Feb. 24 of this year to be with my boyfriend, whom I have a 12 wk. old child with. He was picked up 2 days later for violation of probation and sent back to La. Since then, I have acquired an apartment and a job. My boyfriend's parents, who are licensed foster parents, babysit for me while I work. I received a certified letter today informing me to be in La. on June 2 for a custody hearing for my 2 yr. old. It says I do not maintain employment, use drugs, and am unfit as a mother. I passed a drug test and background check for my job. If I have to go back to La. for court, I will lose my job. How can they sue me in La. if I am a resident of Az.?

Re: My parents are trying to take away my child.
The keys are:
1. The existing custody order is a Louisiana order. Therefore Louisiana has not lost its jurisdiction over the matter; also
2. Because the child has not been living in Arizona for 6 months, for custody jurisdictional purposes his residence is not Arizona yet. It is still Louisiana.
