third party

if a spouse is going through a third party lawsuit and if in the future the couple divorce each other,can the other spouse get half of the money awarded?

Re: third party

Only if both spouses have damage claims, or if the claims are based on the loss of a community asset. So, if the damage is based on one spouse's personal injury for instance, then only the spouse suffering the damage can collect. If part of the damage is for lost wages, then those wages are community assets during the existence of the community.
