Legal Question in Family Law in Louisiana

Past Child support

So the only deductions I am allowed is child support that already exists. Meaning if I currently pay other child support child support it would be less but if I have to pay child support in the future it doesnt count? Who would I need to speak to to see if they would take into consideration that I have two other children I am obligated to support. It seems unfair to future children. It takes away from them to give to the other children.

Re: Past Child support

Mr. Louque is correct. You are not the first person who is paying support for children of a first marriage and have children by a second marriage. You do not get deductions for your present children when calculating child support for children not living with you. RS Title 9 section 315.19 (RS 9:315.19) sets the support based on your and the mother's combined gross income.

Re: Past Child support

It has to be court ordered support. I will not comment on unfairness, it's just how it works.

You are always entitled to a trial on whether the court should deviate from the child support tables, but I would think it rarely ever happens.
