our portion of mom's half
mom died, left everything to dad, my sister and i. dad remarried 6 months later. could my sister and i get our mother's half without a problem since he remarried?

Assuming all the property your mom has was community property, then your dad owns 1/2 and has the use of the other 1/2. It depends what the will states if his remarriage ends the usufruct.
