The husband of the mother is presumed to be the father of the child. That is the strongest presumption in the law. Even if he does a DNA and he is not the father, he agreed to be the father by marrying you and/are acknowledging the child as his by allowing his name to be on the birth certificate. UNLESS THERE IS ANOTHER MAN who wants to accept the paternity of this child, there is little you or your ex-husband can do unless you find a Judge who is willing to bastardize a child. If you have a present husband or you know the real father, then do an intrafamily adoption or have the real father take a DNA test so he can begin supporting his child.
