Legal Question in Family Law in Louisiana

property settlement

what is the law in Louisiana or what are my rights to a home that is owned by me and my ex husband in which he lives in the home and we have been divorced since August 2006? We have not settled on property. He is telling me that he does not have to buy me out and I can not afford another attorney after the cost of one that did my divorce. Please advise.

There is no easy way without an attorney, unless you can file your own PETITION TO PARTITION THE COMMUNITY.

While you're gathering the money you will need for the attorney who will eventually handle your partition you can do the following:

Get an appraisal of the house. By your zip code I'm assuming it is near New Orleans. The value of a habitable home in that area is far higher than it probably was when you bought it. The appraisal only costs a few hundred usually.

Make a list of everything you (as a couple) owned and everyting owed. It all works into the community property.

If you contributed to his advancement (like paying for college) or your separate property, either premarital property or other separate property (the most common is inheritance), contributed to the community you are entitled to consideration for that.

These are a few big pieces of research you can do while acquiring money. The effort should greatly help your case later.
