Legal Question in Family Law in Louisiana
protection against possible future liens on property due to ex's bad credit
Dear Law Guru,
I was granted possession of our primary home. Louisiana state taxes are past due on my ex-husband for 2001 and they are threatening to put a lien on his property. My question is, although the home is still in both our names can the state attach a lien against the property. If so besides getting the mortgage out of his name, what other alternative do I have to protect the property from his creditors since the house was granted to me in the divorce?
Thank you.

First, being granted ownership does not make him less of an owner of the property. Any smart creditor, including the IRS and the Dept. of Revenue, would put a lien on the land and house.
You need to partition the property so that he is no longer an owner.
