Assuming your husband's name is on the birth certificate as the father, or he adopted her, or he acknowledged her later in order for her to have his last name, where is the "real" father? If she has his last name, then I will go on a limb and say he owes child support and will continue to owe support unless and until the biological father is known and steps up to accept the responsibility for his daughter. But maybe you ex-husband will gladly have the last name removed as the girl's last name. How old is the child? Will she be harmed to discover "dad" is really not the man she knew. Too many questions. Speak to your lawyer.
