Reasonable Visitation
My husband was divorced from his first wife in 1999. In his divorce decree, he was granted joint custody and ''reasonable visitation''. We need to know what is meant by this visitation. Would it be the same as what Texas refers to as ''standard visitation''? The ex-wife only granted visitation on sunday afternoons up until about 1 year ago, and now we only get visitation of the kids when it is at her convienence. We need a more concrete idea of the visitation rights. He pays child support faithfully and always has, we also pay her for a non-existant medical insurance policy, what can be done about that?

"Reasonable" means whatever the parties agree to, except USUALLY what is REASONABLE to one is UNREASONABLE to the other. File a rule to set specific visitation rights. Remember that visitation does not depend on payment of child support and vice versa. In that same rule to set specific visitation, you can ask for a recalculation of child support. However, be aware that the recalculation will be based on current gross incomes of both parties, and with limitations, can include the income of new spouses.

"Reasonable visitation" means whatever the parties agree to, so you need to file a Rule to have visitation fixed. With regard to the "non-existant" medical policy, you can file in the same Rule for relief to get out of an expense she doesn't incur. Of course the children should have health insurance coverage which your husband could obtain, and which would be considered in a redertimination of child suppport.
