Legal Question in Family Law in Louisiana
Is it required for spouses with a spousal support Judgment in place to exchange their tax return or W-2 forms with each other yearly in Louisiana so that it can be determined whether the support amount is still recommended? Also, is the maximum amount that can be received still one third of the net income of the payor spouse in Louisiana? Can the Lousiana Judgment for a third of the net income be registered in another state so that the other spouse moves to another state hoping to register the LA Judgment and increase the amount of support in a state that offers up to half of the net income?

Louisiana child support is based on both parties' gross incomes and a statutory chart setting forth the child support obligation. Other considerations are extraordinary expenses-such as private school, medical insurance, etc. unless ordered by Court, there is no exchange of income tax documents. In order to increase or decrease child support there must be at least a 25% increase or decrease in income-a substantial change of circumstances. You can register the child support judgment in another static there is a reciprocal agreement. The judgment originally given controls the amount unless the court allows the case to be transferred.
